Terms of Service

Welcome to Booked Visual. These Terms of Service ("Terms") govern your use of bookedvisual.com and any photography services you book with Booked Visual LLC ("Booked Visual," "we," "us," or "our"). By booking a shoot or using our website, you agree to these Terms.

1. Services

Booked Visual provides professional photography services for short-term rentals, real estate listings, and similar property marketing needs. Our services include on-site photography, professional editing, and digital gallery delivery, with optional add-ons such as drone aerial photography, twilight exterior photography, and video walkthroughs.

2. Booking & Payment

• Bookings are confirmed when payment is received via Stripe.
• Pricing displayed on bookedvisual.com is in US dollars and reflects the package selected.
• You authorize us to charge your selected payment method for the total amount due.
• Add-on services (drone, twilight, video) ordered after the initial booking will be billed separately.

3. Cancellations & Rescheduling

• You may reschedule a shoot at no charge with at least 24 hours' notice.
• Cancellations made less than 24 hours before the scheduled shoot are non-refundable.
• If we need to cancel or reschedule due to weather, equipment failure, or other circumstances, we will offer the next available slot at no extra charge.
• No-shows (photographer arrives but cannot access the property) are non-refundable and a re-booking fee applies.

4. Property Access & Preparation

You are responsible for ensuring the photographer can access the property at the scheduled time, that the property is clean and styled for photography, and that any pets are secured. We provide a "Getting Ready" guide on our website with detailed prep instructions.

5. Delivery

Photo galleries are typically delivered within 24 hours of the shoot. Video and drone deliveries may take longer (typically 48–72 hours). Delivery times are best-effort estimates, not guarantees.

6. License to Use Photos

Once paid in full, you receive a perpetual, royalty-free license to use the delivered photos for marketing the photographed property, including listing platforms (Airbnb, Vrbo, Zillow, MLS), your website, social media, and printed marketing materials. The license is non-exclusive: Booked Visual retains the right to use the photos for portfolio, marketing, and brand purposes.

7. Drone Photography

Drone services are subject to FAA regulations and weather conditions. We do not fly in restricted airspace, in unsafe weather, or without your authorization. If a drone shoot cannot be completed safely or legally, we will offer a refund for that portion of the package.

8. Limitation of Liability

To the fullest extent permitted by law, our liability for any claim arising from our services is limited to the amount you paid for the affected booking. We are not liable for indirect, incidental, special, or consequential damages, including lost bookings or lost revenue.

9. Intellectual Property

All website content, logos, branding, and unedited source files are the intellectual property of Booked Visual LLC. You may not reproduce, redistribute, or sell our content without written permission.

10. Governing Law

These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law principles. Disputes will be resolved in the state or federal courts located in Maricopa County, Arizona.

11. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent revision. Continued use of our services after changes are posted constitutes acceptance of the updated Terms.
